Terms of service

These terms are the agreement between you and SUPERDARKCODELABS PVT LTD, which operates Cyclopes at https://cyclopes.localhost.co.zw. Using the service means you accept them. If you are agreeing on behalf of a company, you are saying you are allowed to.
The privacy policy is part of this agreement and says what happens to data.
What the service is
Cyclopes receives errors, logs and activity from your applications, checks that your endpoints are up, and alerts the people you nominate when something goes wrong. The companion app is a read-only window onto the same account: it can see your data and manage your own account, and it cannot change anything else.
Your account
- You need an account, and you must be old enough to enter a contract where you live, and at least 16.
- Keep your password and API tokens to yourself. Anything done with your credentials is treated as done by you until you tell us otherwise, so tell us quickly if you lose control of them.
- One person, one account. Organizations are how you share access with colleagues; sharing a login instead makes the audit trail meaningless.
- An organization's owners decide who is in it and what they can see. If you join somebody's organization, they can see the work you do in it.
What you send us
You keep ownership of everything your applications send. You give us permission to store and process it only so far as running the service requires. We do not sell it, share it for advertising, or use it to train anything.
You are responsible for what is in it. Specifically:
- You must have the right to send it to us, including having told the people it is about, where the law requires that.
- Do not send payment card numbers, health records, government identifiers, passwords or secrets. Redact them in your own process, before they leave it. If you send them anyway, that is your breach, not our failure to catch it.
- The people you list as alert contacts are being handed to us to be phoned and messaged. Make sure they know.
What you may not do
- Break the law with it, or use it to attack, overload or probe anyone, including us.
- Point uptime checks at endpoints you do not control or have not been given permission to check. A monitor is a request we make on your instruction, and you are the one instructing it.
- Resell the service, or run it as your own product, without a written agreement with us.
- Send volumes plainly meant to exhaust the service rather than to monitor an application.
We may rate-limit or reject traffic that threatens the service for everyone else. Where we can, we will tell you first.
Paying
- Paid plans and alert credits are charged as described at the time you buy them. Prices can change; changes do not apply to something you have already paid for.
- Credits pay for messages we send on your behalf, and are spent when the message is handed to the carrier.
- Card and mobile-money details go to our payment provider, not to us.
- Unused credit is refundable within 14 days of purchase if you have not spent it. Beyond that, ask, and we will be reasonable.
- If a payment fails we will tell you before anything is limited.
What we promise, and what we do not
We will run the service with reasonable care and skill, keep it patched, and tell you honestly when we break it.
We do not promise it will never be down. Cyclopes is a monitor, and a monitor that is down is worth saying plainly rather than burying: if we are offline you may not be told about an outage of your own. Do not make it the only thing standing between you and a failure that would seriously hurt you. There is no uptime guarantee on any plan unless we have signed one with you separately.
Telemetry ages out on the schedule in the privacy policy, and is not a backup. Keep your own copy of anything you cannot lose.
Ending it
- You can stop whenever you like. Deleting your account takes 7 days, and signing in again before then calls it off.
- We may suspend or close an account that breaches these terms. Except where something is causing immediate harm, we will tell you what the problem is and give you a chance to fix it.
- If we close your account, you can ask for a copy of your data for 30 days afterwards. After that it is gone.
- If we ever shut the service down, we will give at least 30 days' notice and refund unused credit.
Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.
Beyond that, neither of us is liable to the other for lost profits, lost revenue or lost data, and our total liability in any twelve-month period is limited to what you paid us in that period. The service is otherwise provided as it is, without further warranties.
Changes
We may change these terms. If a change matters, we will email account holders at least 30 days before it takes effect, and continuing to use the service after that is acceptance. If you do not accept, close your account and we will refund unused credit.
Law
These terms are governed by the law of Zimbabwe, and its courts have jurisdiction. This does not take away any protection the law of the country you live in gives you as a consumer.
